These Terms & Conditions apply to the purchase of products, materials and associated goods from Infinity Effects through our website or directly from us.

By placing an order with Infinity Effects, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes or restricts any statutory rights or liability that cannot legally be excluded.

1. About These Terms

These Terms apply to all orders placed with Infinity Effects unless alternative terms have been expressly agreed by us in writing.

Customers purchasing wholly or mainly for purposes relating to their trade, business, craft or profession are referred to as Business Customers.

Customers purchasing wholly or mainly outside their trade, business, craft or profession are referred to as Consumers.

Different legal rights may apply depending on whether you purchase as a Consumer or Business Customer.

2. Orders

All orders are subject to acceptance and product availability.

Submission of an order does not necessarily constitute acceptance by Infinity Effects.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • Products are unavailable;
  • Payment cannot be authorised;
  • Delivery cannot reasonably be completed;
  • An obvious pricing, specification or description error has occurred; or
  • We reasonably suspect fraudulent or unauthorised activity.

Where we cancel an order after payment has been received, the applicable amount paid for the cancelled goods will be refunded.

3. Prices

Prices will be displayed in the applicable currency.

Prices will state whether VAT is included or added where applicable.

Delivery, pallet, freight, courier and other transportation charges may be additional and will be shown or communicated where applicable.

Infinity Effects may change prices at any time. Price changes will not normally affect orders already accepted by us.

In the event of an obvious pricing error, we are not obliged to supply goods at the incorrect price where it would have been reasonable for the customer to recognise the error.

4. Payment

Payment must be made using one of the payment methods accepted by Infinity Effects.

Unless credit terms or another payment arrangement have been expressly agreed in writing, payment must be received in full before goods are dispatched.

Where credit terms are provided to a Business Customer, payment must be made within the agreed payment period.

We reserve all rights available to us in relation to overdue commercial accounts.

5. Ownership of Goods

To the extent permitted by law, ownership of goods will not pass to the customer until Infinity Effects has received payment in full for those goods.

Risk in the goods will pass in accordance with applicable law and the agreed delivery arrangements.

6. Product Information

Infinity Effects supplies specialist coatings, resins, binders, primers, topcoats, pigments, additives, aggregates, tools and associated products.

We take reasonable care to ensure that product descriptions and specifications are accurate.

However, photographs, renders, digital colour charts, website imagery and samples are provided as visual guides and may not exactly represent the appearance of the finished product.

Customers should review all relevant product information before ordering and using a product.

7. Technical Data & Product Instructions

Infinity Effects products must be stored, prepared, mixed and applied in accordance with the current applicable:

  • Technical Data Sheet (TDS);
  • Safety Data Sheet (SDS);
  • Installation Guide;
  • Product label; and
  • System specification.

Technical information, including coverage rates, pot life, working times, drying times, curing times and consumption rates, is provided as guidance.

Actual performance may vary depending on temperature, humidity, substrate, surface preparation, application thickness, application method and site conditions.

8. Customer & Installer Responsibility

The customer and/or installer is responsible for assessing the intended substrate, application environment and site conditions before using the product.

Appropriate surface preparation must be completed before application.

This may include, depending on the system, grinding, sanding, cleaning, degreasing, priming, moisture testing or other preparation.

Customers must ensure that the products being used are suitable for the intended application and that all applicable instructions are followed.

Where there is uncertainty regarding product suitability, Infinity Effects should be contacted before installation begins.

9. Inspection Before Application

All products must be inspected before opening, mixing or application.

Customers should verify:

  • Product name;
  • Quantity;
  • Colour;
  • Packaging condition;
  • Batch number where applicable; and
  • That the goods correspond with the order.

If you believe an incorrect, damaged or defective product has been supplied, do not mix, dilute, modify, tint or apply the product.

Contact Infinity Effects before proceeding.

Continued installation after an obvious issue has been identified may affect the extent of any claim, subject always to applicable law.

10. Colour, Texture & Batch Variation

Reasonable variation may occur between product batches and between physical products and colours displayed digitally.

Colour and appearance can also be affected by:

  • Substrate colour;
  • Substrate porosity;
  • Application thickness;
  • Application technique;
  • Lighting;
  • Surface texture;
  • Different production batches;
  • Raw material variation; and
  • Screen/display settings.

Customers undertaking larger projects should check products and batch numbers before application and, where appropriate, batch materials together to help maintain consistency.

Natural aggregates, stone and mineral products inherently vary in colour, shade, size and appearance.

Such natural variation is not necessarily considered a product defect.

11. Coverage Rates

Any coverage rate or material consumption figure supplied by Infinity Effects is an estimate unless expressly guaranteed in writing.

Actual consumption depends on factors including substrate porosity, profile, application thickness, wastage, application method and installer technique.

Customers are responsible for ordering sufficient material for their project.

12. Samples

Samples are intended to provide an indication of colour, texture and general appearance.

Samples do not guarantee that subsequent production batches, natural aggregates or installed finishes will be identical.

Customers should approve samples and product selections before placing larger orders where appearance is critical.

13. Delivery

Delivery dates and times are estimates unless expressly agreed otherwise.

Infinity Effects will take reasonable steps to deliver within the estimated timeframe but cannot guarantee delivery dates where delays arise from circumstances outside our reasonable control.

Customers must provide complete and accurate delivery details.

Where applicable, customers are responsible for ensuring suitable access and arrangements for palletised, oversized or commercial deliveries.

14. Delivery Inspection & Damage

Customers should inspect deliveries as soon as reasonably possible.

Visible damage, shortages or incorrect goods should be reported promptly.

Where possible, visible transit damage should be noted with the carrier at the time of delivery and supported by photographs.

Customers should retain damaged packaging and products while a claim is being investigated.

Do not dispose of products subject to a claim unless instructed by Infinity Effects.

15. Failed or Refused Deliveries

Where delivery cannot be completed because:

  • Incorrect delivery information was supplied;
  • Delivery is refused;
  • Suitable access is unavailable; or
  • The customer fails to accept delivery,

reasonable redelivery, return, handling or storage costs may be charged where permitted by law.

16. Consumer Cancellation Rights

Consumers purchasing eligible goods online or through another qualifying distance-selling method may have a statutory right to cancel.

Where applicable, Consumers generally have 14 days from receiving eligible goods to notify us that they wish to cancel.

The goods must then be returned within the applicable statutory return period.

Where permitted by law and where Infinity Effects has informed the Consumer accordingly, the Consumer is responsible for the direct cost of returning unwanted goods.

Nothing in these Terms affects statutory Consumer rights.

17. Custom, Tinted & Made-to-Order Goods

Certain Infinity Effects products may be manufactured, tinted, pigmented, blended, customised or otherwise prepared specifically to a customer’s requirements.

Where the applicable legal exemption applies, goods made to a Consumer’s specifications or clearly personalised are not subject to the normal change-of-mind cancellation right.

Custom, tinted, pigmented, specially manufactured or made-to-order goods are therefore non-returnable where permitted by law unless faulty, incorrectly supplied or otherwise subject to a statutory remedy.

Customers should carefully confirm colours, quantities and specifications before ordering customised products.

18. Business & Trade Orders

Orders made wholly or mainly for business, trade, craft or professional purposes are treated as Business-to-Business (B2B) transactions.

Unless otherwise expressly agreed in writing:

All B2B sales are final.

Correctly supplied goods cannot be cancelled, returned or refunded simply because they are no longer required or because excess material was ordered.

Infinity Effects may choose, entirely at its discretion, to accept a commercial return.

Any such agreement must be provided in writing and may be subject to conditions, including return transport and reasonable handling or restocking costs.

Acceptance of a return on one occasion does not create an obligation to accept future returns.

19. Opened & Used Products

Except where statutory rights apply, products that have been opened, mixed, catalysed, activated, diluted, tinted, contaminated, partially consumed or applied are non-returnable.

This is particularly important for coatings, resins, binders, hardeners, catalysts, pigments and additives because product integrity cannot necessarily be verified after opening.

This does not affect applicable rights relating to faulty, incorrectly supplied or misdescribed products.

20. Returns & Refunds

Returns are governed by our separate Sales & Returns Terms / Returns & Refund Policy, which forms part of these Terms & Conditions.

Products must not be returned without first receiving return instructions from Infinity Effects.

Where a refund is required by law or otherwise approved by Infinity Effects, it will normally be processed using the original payment method.

21. Faulty Products

If you believe a product is faulty, defective, incorrectly supplied or not as described, contact Infinity Effects as soon as reasonably possible.

We may request information reasonably necessary to investigate the issue, including:

  • Order/invoice number;
  • Product name;
  • Batch number;
  • Photographs or video;
  • Details of the substrate;
  • Surface preparation;
  • Mixing procedure;
  • Application method;
  • Application thickness;
  • Temperature and environmental conditions; and
  • Any other relevant installation information.

Customers must provide reasonable access to information and, where appropriate, samples of the affected product to allow the issue to be investigated.

Nothing in this section limits statutory rights.

22. Product Storage

Products must be stored in accordance with their applicable TDS, SDS and packaging instructions.

Customers are responsible for protecting materials after delivery from unsuitable storage conditions including frost, excessive heat, moisture, direct weather exposure and contamination.

Infinity Effects is not responsible for deterioration resulting from incorrect storage or handling after delivery, except where liability cannot legally be excluded.

23. Mixing & Application

Products must be mixed and applied using the correct ratios, equipment and procedures specified by Infinity Effects.

Where products contain separate components, customers must ensure that the correct components are used together and mixed accurately.

Unauthorised additives, solvents, pigments, catalysts, thinners or other modifications may adversely affect product performance.

Infinity Effects cannot accept responsibility for failures resulting from incorrect mixing, unauthorised modification or application contrary to our technical instructions, except where liability cannot legally be excluded.

24. Installation by Third Parties

Unless Infinity Effects has expressly contracted to carry out installation, the sale of materials does not constitute an installation service.

Independent contractors, installers, distributors and training academies are separate businesses unless expressly stated otherwise.

Infinity Effects is not automatically responsible for the workmanship, actions or omissions of independent third-party installers or contractors.

Any warranty specifically offered for an Infinity Effects system may be subject to separate written warranty conditions.

25. Training

Training provided or approved by Infinity Effects is intended to improve understanding of our products and installation systems.

Completion of training does not remove the installer’s responsibility to assess individual projects, substrates and environmental conditions or to follow current technical documentation.

Product systems and specifications may be updated from time to time.

Installers should therefore refer to the latest applicable technical documentation.

26. Warranties

Any product or system warranty offered by Infinity Effects is subject to the specific written terms of that warranty.

A warranty may require, among other things:

  • Use of the complete specified Infinity Effects system;
  • Installation by an approved or certified installer;
  • Correct substrate preparation;
  • Compliance with the current TDS and installation specification;
  • Appropriate environmental conditions; and
  • Records demonstrating correct installation.

A product should not be assumed to carry an installation or system warranty unless this is expressly confirmed.

Statutory rights are unaffected.

27. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Subject to applicable law, Infinity Effects will not be responsible for losses caused by:

  • Incorrect installation;
  • Inadequate substrate preparation;
  • Incorrect mixing or ratios;
  • Failure to follow technical instructions;
  • Use of incompatible products;
  • Unauthorised product modification;
  • Improper storage;
  • Application outside specified environmental conditions; or
  • Continued installation after an obvious issue becomes apparent.

For Business Customers, Infinity Effects will not be liable for indirect or consequential losses, loss of profit, loss of business, loss of contracts or loss of opportunity to the extent such liability may lawfully be excluded.

Any additional limitations applicable to Business Customers may be contained within separate commercial terms agreed between the parties.

28. Third-Party Costs

Where permitted by law, Infinity Effects does not automatically accept responsibility for third-party costs associated with a product claim, including:

  • Contractor labour;
  • Removal costs;
  • Reinstallation;
  • Equipment hire;
  • Accommodation;
  • Travel;
  • Business interruption; or
  • Loss of working time.

Customers should contact Infinity Effects immediately when a suspected product issue is identified and before incurring significant remedial costs.

Nothing in this section excludes liability that cannot legally be excluded.

29. Intellectual Property

All Infinity Effects product names, branding, logos, product imagery, technical documentation, formulations, installation systems, graphics, photographs and other intellectual property remain the property of Infinity Effects or their respective rights holders.

They may not be copied, reproduced, modified, republished or used commercially without prior written permission where such permission is legally required.

Purchase of a product does not transfer any intellectual property rights to the customer.

30. Website Information

We take reasonable care to maintain accurate website information.

We may update products, specifications, packaging, formulations, colours, systems, technical documentation, prices and availability from time to time.

The most current applicable technical documentation should be followed when using Infinity Effects products.

31. Events Outside Our Control

Infinity Effects will not be responsible for delay or failure caused by events outside our reasonable control, subject to applicable law.

These may include transportation disruption, severe weather, supply-chain interruption, shortages, industrial action, governmental restrictions, customs delays and other circumstances that we could not reasonably prevent.

32. Changes to These Terms

Infinity Effects may update these Terms & Conditions from time to time.

The version applicable to an order will normally be the version in effect when the order was placed.

33. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

34. Governing Law

These Terms are governed by the applicable laws of the United Kingdom, subject to any mandatory legal rights that apply to Consumers based on their location.

Nothing in this section deprives a Consumer of any mandatory protections or rights available to them under applicable law.

When contacting us regarding an existing purchase, please provide your order or invoice number.

By placing an order with Infinity Effects, you acknowledge that you have read and agree to these Terms & Conditions, subject to all rights and protections that cannot legally be excluded.
